These Terms and Conditions (“Terms”) govern your use of faytravel.ca and all bookings made through it. Please read them carefully. By using the site or completing a booking, you agree to these Terms and to our Privacy Policy, Cookie Policy and Cancellation & Refund Policy. If you do not agree, please do not use the site.
1. Definitions
- “Faytravel”, “we” or “us”: the operator of the site, an online travel agency based in Canada.
- “You” or “customer”: the person using the site or making a booking, including the travellers booked for.
- “Supplier”: the airline, hotel, transfer or car provider, visa or permit authority, or any party that provides the actual service.
- “Service”: any flight, stay, visa, permit, service or package booked through the site.
2. Eligibility
You must have reached the age of majority in your province (18 or 19 depending on the province) and have the legal capacity to enter into contracts. When you book for others, you confirm that every traveller has authorised you to accept these Terms on their behalf and that you are responsible for payment and for the accuracy of their information.
3. Our role as a travel agent
We act as an agent between you and the suppliers. The service itself is provided by the supplier under its own terms, such as the airline’s conditions of carriage and fare rules and the hotel’s policies, which form part of your agreement when you book. Before you pay, we show you the main conditions that may affect your decision: baggage, refund and change rules, cancellation policy and processing time. Where these Terms and a supplier’s terms conflict about the delivery of the service itself, the supplier’s terms apply.
4. Your account
You can book with or without an account. You sign in with a code sent to your email or with Google. You are responsible for the security of your email and for bookings made from your account, and you must tell us immediately about any unauthorised use. We may suspend an account used in breach of these Terms.
5. Prices
- The price shown before payment is the full price of the service, including every mandatory fee charged by us or the supplier. We never add mandatory fees after the price is shown.
- Applicable government taxes are shown clearly before payment. A hotel may charge fees payable directly at the property (such as a city tax or resort fee); we show them before booking whenever the supplier tells us about them.
- Prices are in the currency displayed. Your bank may convert the amount at its own rate and add its own fees, for which we are not responsible.
- Flight and hotel prices are live and may change until payment. If a price changes, we tell you before any charge and you decide whether to accept the new price.
- If a price is obviously wrong because of a technical or human error, we may cancel the booking and refund everything you paid, or offer you the correct price to accept or decline.
6. Booking and payment
- Flights, hotels and packages: we place a hold on your card and charge it only after the supplier confirms. If the supplier refuses the booking, we release the hold and nothing is charged.
- Visas, permits and other services: charged when you pay, then delivered within the estimated time shown.
- We accept card payments through Stripe. Additional verification may apply to protect you against fraud.
- The contract is formed when payment is confirmed and the booking confirmation is sent to your email; it includes the service details, amount and cancellation terms. Please keep it.
- Travellers’ names must match their passports exactly. Name corrections after issue may be impossible or may carry supplier fees.
- You are responsible for the accuracy of all information you provide. We are not responsible for the consequences of incorrect or incomplete information.
7. Packages (“Plan your trip”)
- “Plan your trip” proposes a package combining a flight with, when available, a hotel stay and the required entry permits, at one total price calculated from suppliers’ live prices.
- A proposal’s price is valid for 30 minutes. We check price and availability again before payment and tell you about any change before charging. The entry permit each traveller needs is added according to the actual nationality entered when booking.
- We place a hold for the total on your card, then book the flight, then the hotel, and charge only what is confirmed. If the flight is confirmed but the hotel cannot be, the hotel is not charged, we tell you, and the flight and the rest of the package remain valid.
- Each part of the package follows its own supplier’s terms and cancellation policy, as shown on your booking page.
8. Flights
- Your flight is governed by the airline’s conditions of carriage and fare rules, including baggage, check-in times and travel documents.
- Not showing up for a flight may lead the airline to cancel the remaining flights in the same booking without refund.
- Airlines may change or cancel flights. We pass on the changes we receive and help you with the available options.
- You have rights directly against the airline for delays, cancellations, denied boarding and damaged or lost baggage under Canada’s Air Passenger Protection Regulations (APPR) or other applicable laws. The airline is responsible for these rights, and we will help you pursue a claim.
9. Hotels
- Your stay is governed by the hotel’s policies, including check-in and check-out times and minimum age. The hotel may ask for official ID and a credit card for a deposit on arrival.
- Special requests (such as bed type or floor) are passed to the hotel but cannot be guaranteed.
- The cancellation policy of the rate you chose applies, as shown before booking and on your booking page.
10. Visas, entry permits and services
- When you order a visa or entry permit, we prepare and submit the application on your behalf based on the information and documents you give us. Approval, refusal and processing time are decided solely by the government authority, and we do not guarantee the outcome.
- Processing times shown are estimates and may be delayed by the authority. We recommend applying well before you travel.
- Service fees and government fees are non-refundable if the application is refused or delayed, unless the refusal results from our error.
- Issued documents are delivered through your booking page. Please check their details as soon as you receive them and tell us about any error.
- Other services (airport transfers, car rental, international driving permits, Umrah) are delivered according to the details shown when booking and their supplier’s terms.
11. Cancellations, changes and refunds
- Flights: under the airline’s fare rules. You can cancel your flight from your booking page more than 24 hours before departure, and we show the refund amount before you confirm. We refund what the airline refunds; our service fee is non-refundable.
- Hotels: under the cancellation policy of the rate you chose (for example, free cancellation until a given date).
- Visas, permits and other services: non-refundable once booked, unless stated otherwise before payment.
- Packages: each part follows its own terms as described above.
- Refunds go back to the original payment method and are usually processed within 7 to 14 business days; your bank may need extra time.
- The cancellation terms shown to you before payment and in your booking confirmation are the reference for your booking. Further details are in our Cancellation & Refund Policy.
- If you dispute any amount, please contact us first so we can resolve it quickly before you contact your bank.
12. Travel documents, health and safety
- You are responsible for a valid passport (ideally valid at least six months after your return date) and for every visa, permit, transit and health requirement of each country you visit or transit.
- We provide general information about entry requirements; the final decision on entry rests with the authorities. We are not responsible for denied boarding or entry due to missing documents.
- We recommend checking the Government of Canada’s official travel advice (travel.gc.ca) before you travel.
13. Insurance
We strongly recommend buying comprehensive travel insurance covering cancellation, medical care, emergencies and baggage before you travel. Our bookings do not include insurance unless expressly stated.
14. The AI assistant and suggestions
The AI assistant and “Plan your trip” provide automatically generated suggestions and answers that may contain mistakes or incomplete information. Only the prices, availability and conditions shown on the payment page and in the booking confirmation are binding. Please check all details before paying.
15. Acceptable use
You may not use the site for fake, fraudulent or speculative bookings, use cards without their owner’s permission, collect data automatically, attempt unauthorised access or disrupt the site, or resell our services without a written agreement with us. We may refuse or cancel any booking we reasonably suspect breaches these Terms, refunding any amount due.
16. Intellectual property
The site’s content, design, logo and software belong to Faytravel or its licensors and are protected by intellectual property laws. They may not be copied, republished or used commercially without written permission.
17. Limitation of liability
- To the extent permitted by law, we are not liable for suppliers’ acts or omissions, for decisions of authorities, or for indirect or consequential losses.
- To the extent permitted by law, our liability to you for any booking does not exceed the amount you paid us for it.
- Nothing in these Terms limits our liability for gross negligence or fraud, or any right that cannot be waived under the consumer protection laws of your province.
18. Force majeure
We are not liable for failure or delay caused by circumstances beyond our reasonable control, such as natural disasters, weather, epidemics, war, strikes, border closures, government decisions or supplier system failures. In such cases, bookings are handled under the suppliers’ terms and applicable rules, and we help you obtain what you are entitled to.
19. Communications
We contact you about your bookings by email, phone or WhatsApp. Please keep your contact details accurate and check your messages, especially before you travel.
20. Complaints
Email info@faytravel.ca with your booking reference and we will reply within 10 business days. If your complaint is not resolved, you may contact the consumer protection office of your province, or its travel-seller regulator where one exists.
21. Governing law
These Terms are governed by the laws of the Canadian province in which our principal place of business is located and the federal laws of Canada applicable there. This does not deprive you of the protection of the consumer protection laws of your province of residence, nor of your right to bring a claim before its courts where the law gives you that right.
22. General
- If any provision is found invalid, the remaining provisions stay in effect.
- Our failure to enforce any right is not a waiver of it.
- These Terms, together with the policies they refer to and your booking confirmation, form the entire agreement between us about the booking.
- These Terms are available in Arabic and English. If the versions differ in interpretation, the English version prevails to the extent permitted by law.
23. Changes
We may change these Terms; changes apply to new bookings from their publication date. An existing booking is governed by the Terms in force when it was made.
